Sen. Rand Paul's office says he was held by the Transportation Security Administration on Monday, although TSA officials deny characterization he was "detained" at Nashville Airport after an incident at the security gate.
Detaining an elected official of the United States government can be a tricky problem. Law enforcement has a problem with first the Constitution Article 1 section 6 as a congressman can always claim to be on Official Business. Second they may be called to justify their actions before a congressional committee, to defend the necessity of the laws they are enforcing. So of course they are denying it was a detention. But what then is a detention?
Webster’s 1828 dictionary
DETENTION, n. [See Detain.]
1. The act of detaining; a withholding from another his right; a keeping what belongs to another, and ought to be restored.
2. Confinement; restraint; as detention in custody.
3. Delay from necessity; a detaining; as the detention of the mail by bad roads.
DETAING, v.t. [L., to hold. See Tenant.]
1. To keep back or from; to withhold; to keep what belongs to another. Detain not the wages of the hireling.
2. To keep or restrain from proceeding, either going or coming; to stay or stop. We were detained by the rain.
Let us detain thee, till we have made ready a kid. Judges 13.
3. To hold in custody.
It seems simple to me if he was not detained under definition 2 in both words. I wonder what dictionary the TSA and the Justice department uses? Newspeak from Minitrue?
US Constitution
Article. I
Section. 6.
The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.
Maybe we just need to have our laws enforced? Not a Police State.
God Bless.
Just my thoughts for today.
